This Privacy Policy explains how Madcraft Inc. (“Madcraft,” “we,” “us,” or “our”) collects, uses, discloses and protects personal information in connection with our U.S. operations, the wearemadcraft.com website and related pages, our marketing and business-development activities, and the digital and professional services we provide.
“Personal information” means information that identifies, relates to, describes or could reasonably be linked with an individual or household. It does not include information that has been deidentified or aggregated so that it cannot reasonably identify an individual.
This Policy does not apply to employee or job-applicant information governed by a separate workforce notice. It also does not replace the privacy notice of a Madcraft client when we process personal information solely on that client’s behalf. In those circumstances, the client determines how the information is used, and questions or rights requests should generally be directed to that client.
Information you provide directly. We may collect names, email addresses, postal addresses, telephone numbers, employer and job-title information, account or login details, billing and transaction information, project information, support requests, correspondence, meeting information, survey responses, marketing preferences and other information you choose to provide through forms, inquiries or interactions with us.
Information collected automatically. When you visit our website or use our digital services, we may collect IP addresses, device identifiers, browser type, operating system, referral URLs, pages viewed, clicks, scrolling and other interaction data, approximate location derived from an IP address, cookie identifiers and similar technical information.
Information from clients and business partners. Clients may provide contact information, project content, account information, support data or other personal information necessary for Madcraft to provide contracted services. We may also receive professional contact information from business partners, referrals, events, service providers and publicly available professional sources.
Payment information. Payments may be processed by third-party payment providers. Madcraft generally does not retain complete payment-card numbers or security codes.
Sensitive personal information. Madcraft does not intentionally request health information, government identification numbers, biometric information, precise geolocation or other sensitive personal information for ordinary business purposes. Account credentials and the contents of communications may be treated as sensitive under certain laws and are used only for legitimate operational, security and service-delivery purposes. Madcraft does not use sensitive personal information to infer characteristics about individuals.
We may use personal information to provide, operate and improve our website and services; design, develop, host, maintain and support websites, portals, applications and digital platforms; manage accounts, projects and client relationships; respond to inquiries and support requests; process transactions and billing; communicate about services, events and business opportunities; send marketing communications where permitted; personalise website content and measure campaign performance; conduct analytics and research; protect systems and prevent fraud, misuse or security incidents; enforce contracts and protect legal rights; support corporate transactions; and comply with legal, regulatory, tax, accounting and reporting obligations.
Where consent is required by applicable law, we will seek consent before processing personal information for the relevant purpose. Individuals may withdraw consent at any time, subject to legal and contractual limitations and the lawfulness of processing undertaken before withdrawal.
We may disclose personal information to service providers that support hosting, cloud infrastructure, information technology, cybersecurity, communications, customer-relationship management, analytics, advertising, payment processing, accounting and professional services. These providers may use personal information only as permitted by their contracts and applicable law.
We may also disclose personal information to Madcraft affiliates and authorized contractors where necessary to deliver services; to clients where Madcraft processes information on their behalf; to professional advisers such as lawyers, auditors and insurers; in connection with a merger, financing, acquisition, reorganisation or sale of all or part of the business; to public authorities or other parties where required by law or reasonably necessary to protect rights, safety and security; and to other parties at an individual’s direction or with consent.
Madcraft does not sell personal information for monetary consideration. We also do not provide personal information to unrelated third parties for their own direct-marketing purposes.
Some analytics, advertising and social-media technologies may involve disclosures that are considered a “sale,” “sharing” or use for targeted advertising under certain U.S. state privacy laws, even when no money changes hands. Where applicable, individuals may opt out by using available cookie controls, sending a request to [email protected] or using a legally recognized browser-based opt-out preference signal.
Where applicable law requires it, Madcraft honors a valid Global Privacy Control signal as an opt-out of sale or sharing for the browser or device that sends the signal. Because there is no uniform standard for browser “Do Not Track” signals, we do not respond to those signals unless required by law.
Madcraft and its service providers use cookies, pixels, tags, local storage and similar technologies to operate the website, remember preferences, understand traffic and engagement, secure the website, measure performance and, where permitted, support advertising and personalization.
Individuals can manage cookies through available consent controls and browser settings. Disabling cookies may affect website functionality. Additional information is available in Madcraft’s Cookies Policy.
We may send business and marketing communications in accordance with applicable law. Recipients may unsubscribe from marketing emails using the link contained in the message or by contacting us. Opting out of marketing does not prevent us from sending non-promotional communications concerning an existing account, project, transaction, security matter or legal obligation.
Madcraft may process personal information as a service provider or processor on behalf of clients in connection with websites, portals, applications, digital marketing, analytics, hosting, maintenance and support services. The relevant client controls the purposes and means of that processing. Madcraft processes such information according to the client’s documented instructions, applicable agreements and law.
If a request concerns information that Madcraft holds solely for a client, we may direct the individual to that client and will assist the client as required by contract and applicable law.
Madcraft retains personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining business and transaction records, resolving disputes, enforcing agreements, protecting security and meeting legal, tax, accounting and reporting obligations.
Retention periods vary according to the nature of the information, the reason it was collected, contractual requirements and applicable law. When personal information is no longer required, Madcraft will delete, anonymize or securely dispose of it, subject to lawful backup and record-retention processes.
Madcraft maintains reasonable administrative, technical, organizational and physical safeguards designed to protect personal information against loss, misuse, unauthorized access, alteration, disclosure or destruction. These measures are reviewed and adjusted based on the nature of the information and relevant risks.
No method of transmission or storage is completely secure. Accordingly, Madcraft cannot guarantee absolute security. Individuals should protect their credentials and notify us if they suspect unauthorized activity involving a Madcraft service.
Madcraft and its service providers may process personal information in the United States and other countries that may have different data-protection laws from the individual’s home jurisdiction. Where required, Madcraft uses appropriate safeguards for international transfers, such as contractual protections and recognized transfer mechanisms.
If and when Madcraft Inc. relies on the EU-U.S. Data Privacy Framework for a transfer, the additional commitments applicable to that data are described in Madcraft’s EU-U.S. Data Privacy Framework Privacy Notice. That notice should be linked and published only after Madcraft is authorized by the U.S. Department of Commerce to state its participation.
Depending on an individual’s location and applicable law, privacy rights may include the right to request access to or confirmation of personal information; obtain a portable copy; correct inaccurate information; request deletion; opt out of sale, sharing, targeted advertising or certain profiling; limit certain uses of sensitive personal information; withdraw consent; object to or restrict certain processing; and appeal a decision concerning a privacy request.
Madcraft will not unlawfully discriminate against an individual for exercising an applicable privacy right. These rights may be subject to exceptions, and Madcraft may decline or limit a request where permitted by law.

An authorized agent may submit a request where permitted by law, but Madcraft may require proof of authority and verification of the individual’s identity.
Madcraft will respond within the period required by applicable law. If Madcraft denies an appealable request, the response will explain the reason and provide instructions for appealing where required.
During the preceding 12 months, Madcraft may have collected the following categories of personal information: identifiers and contact information; customer records; commercial and transaction information; professional and employment-related information; internet and electronic-network activity; approximate geolocation; audio, electronic or visual information provided during communications; account credentials and communication contents where applicable; and inferences drawn from interactions with our website and services.
Madcraft obtains these categories from individuals, clients, business partners, referrals, service providers, website technologies and publicly available professional sources. We use them for the business and commercial purposes described in Section 3.
Madcraft may disclose these categories for business purposes to the recipients described in Section 4. We do not knowingly sell or share the personal information of individuals under 16 years of age. Madcraft does not offer financial incentives or differences in price or service in exchange for personal information.
California residents and residents of other states with applicable privacy laws may exercise the rights described in Section 12. California residents may also request information about the categories of personal information collected, sources, purposes and categories of recipients. Where applicable, they may opt out of sale or sharing and limit certain uses of sensitive personal information.
Madcraft’s website and services are intended for businesses and are not directed to children under 16. Madcraft does not knowingly collect personal information directly from children under 16 through its website. If we learn that such information was collected without appropriate authorization, we will take reasonable steps to delete it.
Where Madcraft processes information about children solely on behalf of a client, the client is responsible for determining the appropriate legal basis and providing required notices and consents, and Madcraft acts according to the client’s instructions.
Our website may contain links to third-party websites or services. Madcraft does not control those third parties and is not responsible for their privacy practices. Individuals should review the privacy notices of third parties before providing personal information to them.
Madcraft may update this Policy to reflect changes in its services, practices or legal obligations. The updated version will be posted with a revised “Last Updated” date. If a change materially affects how Madcraft uses personal information, we will provide additional notice or obtain consent where required by law.
